Graham to make second run at blocking civilian trials for Gitmo terror suspects

By Jordan Fabian - 11/19/09 03:23 PM ET

Sen. Lindsey Graham (R-S.C.) on Thursday said he would make another attempt to halt the trials of so-called Sept. 11 "mastermind" Khalid Sheikh Mohammed and other co-conspirators.

Two weeks ago the Senate turned aside an amendment Graham proposed that would have cut funding for the civilian trials. The upper chamber tabled the measure in a 54-45 vote. The former military prosecutor said that he would introduce a bill in the Senate sometime this week.

"I'm going to try to get another vote on my bill," Graham told conservative talk radio host and lawyer Jay Sekulow on Thursday.

Last week, Graham had said that he would stay silent on the Sept. 11 terror trials until after he met with President Barack Obama. The president returns from his trip to Asia on Thursday.

Graham has argued that the Sept. 11 co-conspirators deserve a fair trial before a military tribunal, but has said a civilian trial would pose intelligence and military risk to the United States. Graham and his Senate ally John McCain (R-Ariz.) support closing the detention center at Guantanamo Bay but say military tribunals should handle the cases because they would not have to expose sensitive intelligence during a trial.

"I don't mind having enemy prisoners in American military jails in the states," he said. "[But] you're rewarding the terrorists for killing civilians [by having a civilian trial]."

Most Democrats opposed Graham's effort two weeks ago, arguing that it would prevent the Obama administration from seeking justice for the terrorists. Attorney General Eric Holder has said that sensitive intelligence would not have to be revealed at trial and vowed that federal prosecutors would secure a conviction.

The five Democrats to vote against the tabling two weeks ago were Sens. Jim Webb (Va.), Maria Cantwell (Wash.), Mark Pryor (Ark.), Blanche Lincoln (Ark.) and Joe Lieberman (Conn.), an Independent who caucuses with the Democrats.

Is it true that Lindsay Graham is really the late Mr. Rogers' long lost love-child?BY Not So Mavericky on 11/19/2009 at 16:17
This garbage has gone too far. It is incomprehensibl e why international military terrorists are to be tried in US civilian court, and a radical Muslim was allowed to remain in the US military despite treasonous and harmful intentions. I love our country but I'm embarrassed by our complete incompetence and foolishness in these matters. Persevere, Sens. Graham and Lieberman.BY Maureen on 11/19/2009 at 17:18
When transnational combatant terrorists attack civilians it is a war crime. When they do not wear uniforms it violates the Geneva Conventions. By not wearing uniforms and by hijacking civilian aircraft they got inside our air defenses on 9/11. To let them again, this time get inside national defenses(milita ry, legal, intelligence gathering) , by conveying upon them US civilian status, is beyond nutty and obtuse, and in spite of what Holder said, it does not recognize we are at war with mass murder religious bigots. It mocks and undermines the Geneva Conventions because then only our forces will be required to meet those standards. They will be given more rights than those who attacked the USS Cole. They will be given more rights than uniformed soldiers who attack us. KSM is not a civilian, he is a combatant who dresses like a civilian, but in or out of uniform he is a soldier just as Major Hasan. Why is it so hard for Obama and Holder to see what is obvious? This is not just a legal matter, it is a national security issue. We need to rally behind Senator Graham to stop a very bad precedent from opening on Broadway.BY graham on 11/19/2009 at 17:19
It is becoming more clear that the Obama administration to include the attorney general are bunkers. It is becoming increasingly clear that Obama is sensitive toward Islam and its murderers. This may prove that Obama is in fact a Muslim at heart if not a registered member of that nutty religion. His Chicago connection wherein the largest black population of Muslims exist is his continuancy when he was a Illinois senator and even when he ran for president. They served as his security.BY larry stinson on 11/19/2009 at 19:44
They wear the uniform of the "Islamic Warriors of God", they are soldiers in the army of "Allah". To call what they wear as civilian attire is false. They do not have the privilege of a civilian trial. They are "War Criminals. They should be properly tried , properly convicted and properly Hanged…Emo Zipper 11.19.09BY Emo Zipper on 11/19/2009 at 19:47
This silly little twerp never saw a war he didnt like or a Muslim he didnt want to kill. Shame on S. Carolina for re-electing him.His fretting over the trials in NY while Obama and Democrats try to take over the US economy is like someone worrying about a smudge on the carpet while the house is on fire.BY Mike on 11/19/2009 at 21:28

"Punch will stun West," reads the headline above the fold on Drudge this Tuesday. The line refers to Iranian President Mahmoud Ahmadinejad's recent, vague promise this week to somehow "punch the arrogance" of the West on February 11. Also above the fold: A slew of weather-related links, including a report from the National Weather Service that predicts more snow for the already buried Capitol.… Read More »

"Healthcare theatrics" reads the banner atop The Huffington Post, which links to an AP story on the White House's struggle to bring GOP leaders to the table for a televised healthcare summit. The AP questions whether the event may have any utility outside of immediate personal politics. Below, reporter Sam Stein reports Sen. Ben Nelson (D-Neb.) plans to vote against the White House's nominee for the National Labor Relations Board (NLRB), Craig Becker.… Read More »

Moe Lane this morning summarizes the latest back-and-forth between the White House and congressional GOP leaders over healthcare. The White House wants Republicans to join Democrats for a televised healthcare summit in the coming days, but GOP leaders do not want Democrats' bill to be the basis for those talks. Meanwhile, Brian Darling takes on NYT columnist Paul Krugman's latest piece, in which he rails on the filibuster (and the GOP's use of it). "He is clearly way outside of his area of expertise when talking about Senate procedure, because his analysis is laughable," Darling writes.… Read More »

Spencer Ackerman leads The Washington Independent this morning with a post about William Lietzau, a top Obama White House appointee first installed during President George W. Bush's tenure. Lietzau handled the military commissions the Supreme Court later found unconstitutional, and Ackerman reports that he will soon become Deputy Assistant Secretary for Detainee Affairs.Earlier, David Weigel shared Defense Secretary Robert Gates' thoughts on the passing of Pennsylvania Rep. John Murtha (D). Noted Gates: "In our dealings over the years, Jack and I did not always agree, but I always respected his candor, and knew that he cared deeply about the men and women of America’s military and intelligence community." … Read More »
