Dodd introduces constitutional amendment to reverse SCOTUS on campaign spending

Sen. Chris Dodd (D-Conn.) introduced a constitutional amendment today to overrule a recent Supreme Court decision on campaign spending.

The court ruled 5-4 last month in Citizens United v. FEC that Congress cannot regulate independent expenditures by corporations and possibly labor unions. The ruling could dramatically increase third party spending on elections.

Dodd's amendment, co-sponsored by Sen. Tom Udall (D-N.M.) would explicitly grant Congress the authority to regulate campaign fundraising and expenditures for federal elections.

The amendment would also let states regular such activity in their own elections.

"I strongly disagree with the Supreme Court’s conclusion that money is speech, and that corporations should be treated the same as individual Americans when it comes to protected, fundamental speech rights,” Dodd said in a statement.

Dodd and Udall said they will also support "interim legislative efforts" to damper the impact of the ruling, including requirements that corporations disclose their campaign spending.

To pass, Dodd's amendment must pass both Houses with a two-thirds majority and be ratified by three-quarters of the states.

I think a Constitutional Amendment barring any outgoing member of Congress from introducing legislation. They can only vote on other bills that are brought up. No Golden Parachute or parting shots. Could they call this the Fox guarding the Chicken House amendment?BY Chip on 02/24/2010 at 16:11
Isn't the problem that the Supreme Court re-wrote the constitution in order to declare that legal entities created under federal law have constitutional rights to free speech that everyone thought were only granted to the people? Therefore they essentially turned the constitution on its head and declared that it's no longer government by the people and for the people, but also for the legal entities created and licensed by the people. Dodd has benefitted from his Senate seat, taken Wall Street money, and is arrogant. If he had any courage, he would restrict the amount of money candidates can spend in a campaign so the "common person" could have a shot at Congressional seats. Better still lets have a constitutional convention and hash out a lot of this countries ills fostered by the courts. Steve you hit the nail on the head. Only when every candidate pulls cash from the same pot will elections be fair and balanced. When both sides have exactly the same amount of cash with the question of who can raise the most be the deciding factor.
