The health law's foes appealed to the justices' idea of liberty in their arguments. Republican operatives altered Supreme Court audio in an ad mocking the solicitor general's defense of the health law. Europe is also wrestling with a flawed healthcare system. Insurers — and Republicans — are objecting to letters the industry is required to send crediting the healthcare reform law for customer rebates. Deaths from all cancers combined for American men, women and children continued to decrease between 2004 and 2008.

Healthcare reform advocates prepare Plan B. Insurers ponder a world without an individual mandate. Even without the mandate, the law would still affect millions. The Supreme Court arguments might end up demonstrating that free-market solutions simply can't provide affordable care to all. A demonstration program that inspired the health law's effort to reward hospitals based on performance has failed to lead to fewer deaths.

Democrats regrouped and Republicans rejoiced on Wednesday after three days of intense arguments at the Supreme Court left President Obama's signature domestic achievement hanging in the balance. The justices appeared more divided in their discussions over whether the whole law should fall than they were Tuesday regarding the law's individual mandate, Healthwatch's Sam Baker reports from inside the court. That left lawmakers reverting to talking points about the law as the justices left them in the dark. Read the Healthwatch story here. The 'real' Congress: Congress is so broken even the Supreme Court justices now have to worry about lawmakers' inability to get along and fix the healthcare law if they strike down its individual mandate.
