Resolution urges FCC not to reclassify broadband

Reps. Fred Upton (R-Mich.) and Gene Green (D-Tex.) introduced a resolution this week to urge the Federal Communications Commission (FCC) not to move to increase its authority over Internet service providers and to instead await congressional action.

The resolution has 48 co-sponsors, including 24 Democrats.

“Currently, Congressional Leadership is working on crafting targeted legislation aimed at broadband Internet. It is important that the FCC gives Congress time necessary to complete its work," Green said in a statement, citing the possibility of lengthy court battles if the FCC acts to boost its power without waiting for a law that clarifies its authority.

The scope of FCC authority was cast into question by a federal appeals court decision in April.
