Hutchison: Overturning FCC's net-neutrality plan will be tough

By Gautham Nagesh - 12/30/10 02:44 PM ET

Sen. Kay Bailey Hutchison (R-Texas) conceded Wednesday that overturning the Federal Communications Commission's recently passed net-neutrality rules will be difficult with Democrats still in control of the Senate and the White House.

"As long as the Democrats are in control of the Senate and the president believes this is the way to govern, we will have a hard time shutting it down," Hutchison told host David Asman on Fox Business Network. "But I hope enough Democrats will come alongside us in the Senate and Republicans in the House and say this is wrong."

Hutchison has been one of the most vocal opponents of FCC Chairman Julius Genachowski's plan, which the commission approved last week by a 3-2 vote along party lines. She has vowed to introduce a resolution to disapprove the legislation, which would require a majority in both chambers.

But she acknowledged the possibility of a veto from President Obama even if the Republicans can convince enough Democrats to support the resolution. She also promised to try to use the appropriations process to prevent the FCC from enforcing the new rules.

"Another way we can try to stop them is cut off their funds to implement this regulation, which we will try to do," Hutchison said.

(Asman opened the interview by citing a recent Rasmussen survey that shows only one in five voters want the Web regulated in a similar fashion to radio and television, but misidentified the regulatory agency as the SEC, prompting Hutchison to make the same mistake in her comments.)
