West Virginia governor holding rally to protest EPA veto of major mine project

EPA announced Thursday that it is using its Clean Water Act authority to veto the Spruce Number One Mine. The decision marks the first time the agency has vetoed a project that has already been approved. The permit for the project was approved in 2007, but it never moved forward because it was caught up in a number of legal battles.

Tomblin slammed the agency for its decision Thursday and said he would continue to pursue a lawsuit filed by his predecessor, Joe Manchin, who is now one of the state's U.S. senators.
