Pelosi slams Boehner, says cost of DOMA legal defense now $3M

House Democratic leaders slammed Speaker John Boehner (R-Ohio) on Tuesday for quietly spending more money to defend the Defense of Marriage Act (DOMA) in court.

They said Boehner has now committed $3 million to the legal defense for DOMA — a sharp increase from the roughly $1 million initially reported.

{mosads}”From the start, the Republican-led campaign to defend DOMA has been a practice in futility and a waste of Americans’ hard-earned tax dollars,” Minority Leader Nancy Pelosi (D-Calif.) and Minority Whip Steny Hoyer (D-Md.) said in a letter to Boehner.

Boehner is defending DOMA — the federal law that defines marriage as a union between one man and one woman — through an entity called the Bipartisan Legal Advisory Group (BLAG). But Pelosi and Hoyer said the BLAG is being misused because it’s supposed to represent the views of the full House.

“Let us be clear: these steps do not reflect the will of the House or the consensus of the BLAG,” Pelosi and Hoyer wrote. “Democrats do not support any decisions to invest taxpayer funds in defense of an indefensible law. We remain united in our opposition to any effort to preserve, protect, and defend discrimination in our country.”

Pelosi and Hoyer are the Democratic representatives of the BLAG. At a minimum, they said, Boehner should publicly disclose how much is being spent on outside counsel to argue DOMA.

The BLAG has lost all of its cases. Its biggest test will come in March, when the Supreme Court is slated to hear oral arguments over DOMA’s constitutionality. A ruling is expected this summer.

“We believe it is only a matter of time before this offensive law is a discarded relic of a bygone era,” Pelosi and Hoyer wrote. “We look forward to the day when this measure is declared unconstitutional by the highest court in the land and when all of America’s families can know the blessings of equal protection under the law.”
